8. TRANSPORT
8.1 The transport costs , unless otherwise stated in writing, shall be borne by the customer. The Seller reserves the right to charge
the customer any additional charges added to the pure cost of transport eventually paid to the Carrier.
8.2 The expedition, even if carried out in freeport, travels at the risk and peril of the customer. The Seller is not liable for delays,
failures, breakdowns, breakages or missing items and any facts that may occur during transport. Even in the case where the carrier
is chosen by the Seller.
8.3 In no event eventual damage arising from transport entitle the customer to delay payment of the invoice relating to the goods,
or to retain part or all of its amount .
8.4 Although chosen by the Seller, up to the customer to submit any claims to the carrier, possibly with a declaration of immediate
dispute.
9. GUARANTEE
9.1 Rubinetteria Paffoni spa warranty covers sanitary mixers for bathroom and kitchen for 5 years from the purchase date, thermostatic
components, hand-showers, shower heads, shower columns and sliding rails for 2 years. The warranty is not renewable.
The guarantee referred to in this Article 9 covers only defects which appear under normal conditions of use of the Product.
The guarantee includes:
• defects of cast or porosity
• chrome plating defects
• operating defects of the cartridge
• manufacturing defects recognized by our technical office
In order to preserve the quality of the finishings , the cleaning of all surfaces (chrome, gold, colored or plastic) is recommended by
using a soft cloth with water and soap only. Abrasive cleaners or acidic or corrosive are not to used .
9.2 This warranty is instead excluded and therefore not applicable in the following cases:
• deterioration of chromed or colored surface due to the use of cleaning products containing acids or abrasive
• esthetic defects such as scratches, marks or dents not been notified prior to installation of the product
• accidental dents caused by the negligence in use or intentional
• insufficient maintenance (ex.: failure to clean filters)
• incorrect operation of the product due to water quality (ex.: limestone, rust, non-potable water with the presence of foreign
bodies ...)
• use of non-original spare parts
• operating pressure higher than 5 BAR
• exposure of the product to very high (+80 ° C) or too low (-0 ° C) temperatures
• repairs, maintenance or tampering of products made by unauthorized personnel not previously agreed with the Company
• tampering or removing of the cartridge
• incorrect or uneven installation of the products as described in the instructions-manual, causing damage to the product itself, or
use of the product other than indicated
• neglect in the yard
• in any other case of non-compliance with the instructions for installation, use and maintenance contained in the sales package
• wear of the Product.
9.3 Without prejudice to the provisions of section 10 (CLAIMS), in the event of a defective product under warranty, Rubinetteria
Paffoni spa, in his sole judgment, will replace or repair the non-conforming product or parts of it, or refund the price should the
replacement not be possible. In any case, without further compensation or damages for any direct and / or indirect, incidental or
consequential damages, which may arise from the defects and / or nonconformity of the Product; such compensation should therefore
be construed expressly waived by the Customer, to the extent permitted by law.
9.4 To activate the guarantee it is necessary to contact directly the supplier (hydraulic, retailer or wholesaler), presenting the warranty
card included in the sale box, duly filled in and stamped by the dealer with the date of purchase or otherwise presenting other proof
of purchase date; in any case, for the activation of the guarantee, the customer must prove the traceability of the article to the
production of the Seller.
9.5 Each authorization of return of goods will be identified with a reference number (RMA), communicated by our Italian Customers
Office. The reference number (RMA) must be written clear and readable on the box and on the delivery note. Back shipment without
reference number (RMA) will not be considered.
9.6 The material to be sent back, prior express authorization of the Seller, must be sent postage paid to its headquarters in Pogno,
in free packaging and clear indication of the Authorization number (RMA). The Seller will not accept back-shipments incomplete in
quantity or/different in type of goods than as expressly authorized.
9.7 The above rules will be also applied in the case of returns for incorrectly ordered goods, the value of which will be repaid by
deducting 15% to cover the expenses necessary for the management and recovery of the material.
9.8 Eventual approvals, declarations, commitments and / or warranties made by agents and / or employees of the Seller, even if made
in writing, which do not conform to or are in contrast to what stated in these Terms and Conditions of sale, they have no value and
are not accepted by the seller, unless they are signed by the legal representative of Rubinetteria Paffoni SpA.
