General sale conditions

10. COMPLAINTS
10.1 The Customer, under penalty of forfeiture of the guarantee, must carefully examine each product in order of verifying
consistency of the supply with the quantity and quality of the products listed in the Order Confirmation, and the existence of obvious
defects.
10.2 Within 8 days after receipt of the goods, the customer is required to notify the Seller in writing, under penalty of forfeiture of
the guarantee, the existence of defects or discrepancies in quantity or quality of the Products. After that period, the supply will be
considered without reservation by the Customer, with the subsequent waiver of the same to support any clear fault of the product as
well as any quantitative or qualitative defect of the supply.
10.3 The presence of latent defects not detectable at delivery must be notified, under penalty of forfeiture, within 8 days of the
discovery, as expected for obvious defects.
10.4 In the case of repeated deliveries of products having the same characteristics, the Customer waives any claim arising from quality
defects, if the same have been previously accepted and no objection was made in writing.
10.5 The Seller shall be entitled in its absolute discretion to examine the products object of defect claim. Even in this case, the Vendor
will not accept any approval, declaration, commitment and / or warranty made by agents and / or employees of the Seller, even if
made in writing, unless they are signed by the legal representative of Rubinetteria Paffoni SpA.
10.6. Any norm in rule, relating to the consumer protection, is not affected by these Terms.
11. TECHNICAL AND INDUSTRIAL PROPERTY
11.1 The illustrations shown in catalogs and brochures or other advertising material issued from the Seller have the sole purpose of
representing the individual items and do not constitute a sample of the products sold. The details, measurements and weights are
purely descriptive of the actual size of the products, therefore, the seller assumes no responsibility for any discrepancy.
11.2 The Seller reserves the right to make any change to articles showed in the catalogue or otherwise produced, including the
termination of their marketing.
11.3 The rights associated to industrial ownership and to know-how of the products purchased under no circumstances can be
considered transferred to the customer, as Rubinetteria Paffoni SpA remains the exclusive owner of the
same.
11.4 The Customer expressly agrees not to make use of drawings and technical information for purposes other than those strictly
related to the sale, including their reproduction on all media.
11.5 The Customer also acknowledges that the trademarks, trade names and distinctive marks on the merchandise are sole property
of Rubinetteria Paffoni spa and for no reason can be changed or removed. The use of trademarks and other distinctive feature is
limited to the purposes strictly related to the sale.
11.6 Any other use not expressly authorized in writing by Rubinetteria Paffoni SpA means violation, by the customer, of these exclusive
rights.

12. APPLICABLE LAW AND JURISDICTION
12.1 Any relationship and / or litigation between the parties will be governed and regulated by Italian law.
12.2 Any dispute arising between the parties is under the exclusive competence of the Court of Novara.
13. PERSONAL DATA (Legislative Decree 196/2003)
Within the meaning and for the purposes of the Legislative Decree 196/2003, the undersigned declares to have received notification
referred to ‘Article 13 of this law and to have read the rights granted by the same. Consequently, he gives the unconditional consent
to the processing, communication and diffusion in Italy and abroad, even in countries outside the European Union, of their personal
data, including “sensitive data”. This processing to the aim of cataloguing, preservation and recording of the same in the company is
archives, as well as managerial, promotional, advertising, transmission of commercial and technical information, market researches
and in particular, without limitation, all purpose such as to ensure greater protection and safety of the goods purchased.

The following provision will be applied only to sales of products to customers based in Italy in accordance with the provisions of Articles
1341 and 1342 of the Italian Civil Code, the Customer declares to approve the provisions contained in the following paragraphs:
